Terms of Service

These Terms of Service ("Terms") govern your access to and use of flash.ink and the services provided by Flash ("Flash," "we," "us," or "our"), collectively referred to as the "Services."
By accessing or using Flash, you agree to these Terms.
1. The Flash Platform
Flash provides a technology platform that helps tattoo artists and clients discover one another, communicate, schedule appointments, manage bookings, and access related services.
Unless explicitly stated otherwise, Flash is not a tattoo studio and does not itself provide tattoo services.
Tattoo services are provided by independent tattoo artists and/or studios. Artists are responsible for their services, pricing, availability, licensing, safety practices, and compliance with applicable laws and regulations.
2. Accounts
You may need to create an account to use certain features of Flash.
You agree to provide accurate information and keep your account information current.
You are responsible for activity occurring through your account and for maintaining the security of your account and authentication credentials.
You must notify Flash if you believe your account has been accessed without authorization.
3. Tattoo Artists
Artists using Flash are responsible for maintaining any licenses, permits, certifications, insurance, or other requirements applicable to their services.
Artists are responsible for accurately describing their services, pricing, availability, booking requirements, cancellation policies, and other relevant information.
Flash does not guarantee the quality, safety, legality, availability, or suitability of services provided by an artist.
4. Clients
Clients are responsible for providing accurate booking information and communicating relevant information to their selected artist.
Clients are responsible for determining whether an artist and tattoo service are appropriate for them.
Artists may impose additional requirements regarding identification, age, deposits, cancellations, preparation, aftercare, or other matters.
5. Bookings and Appointments
Flash may allow clients to request, schedule, modify, and manage tattoo appointments.
A booking may be subject to acceptance by the artist.
Artists may establish their own availability, pricing, deposits, cancellation rules, and booking requirements.
Flash does not guarantee that an artist will accept or complete any particular appointment.
6. Payments and Deposits
Flash may facilitate payments between clients and artists.
Certain bookings may require deposits or other payments.
Applicable prices, deposits, fees, cancellation policies, and refund conditions should be presented during the booking process or otherwise communicated by the artist.
Payment processing may be provided by third-party payment providers and may be subject to additional terms.
7. Cancellations and Refunds
Cancellation, rescheduling, deposit, and refund policies may vary by artist or booking.
Users are responsible for reviewing applicable booking terms before completing a transaction.
Where Flash provides platform-wide cancellation or refund rules, those rules will be disclosed during the applicable transaction.
8. Communications Between Users
Flash may allow artists and clients to communicate through the Services.
You agree not to use Flash communications to:
- Harass, threaten, or abuse another person
- Send spam or unsolicited advertising
- Engage in fraud or deceptive conduct
- Distribute illegal or harmful content
- Violate another person's intellectual property, privacy, or other rights
Flash may investigate misuse of its communication features and restrict accounts where appropriate.
9. SMS Messaging Terms
Users may choose to receive SMS messages from Flash relating to their account and activity on the platform.
Messages may include secure sign-in links, authentication messages, booking confirmations, appointment reminders, appointment updates, payment or deposit notifications, new-message notifications, and other service-related communications.
Message frequency varies. Message and data rates may apply.
You may opt out of SMS messages at any time by replying STOP.

Consent to receive SMS messages is not a condition of purchasing goods or services or using the core Flash platform.
Wireless carriers are not liable for delayed or undelivered messages.
Mobile phone numbers, SMS opt-in information, and messaging consent will not be sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes.

10. Acceptable Use
You may not use Flash to:
- Violate applicable law
- Impersonate another person or business
- Commit or facilitate fraud
- Interfere with the security or operation of the Services
- Attempt to access accounts or systems without authorization
- Scrape or automatically collect information from Flash without authorization
- Upload malicious code
- Use the Services in a manner that infringes another person's rights
We may suspend or terminate access for violations of these Terms.
11. User Content
Users may submit photos, portfolio images, profile information, messages, reviews, descriptions, and other content through Flash ("User Content").
You retain ownership of your User Content.
By submitting User Content to Flash, you grant Flash a non-exclusive, worldwide license to host, store, reproduce, display, and otherwise use that content as reasonably necessary to operate, provide, promote, and improve the Services.
You represent that you have the necessary rights to submit the content you provide.
12. Intellectual Property
The Flash platform, including its software, branding, design, logos, and other materials provided by Flash, is owned by Flash or its licensors and is protected by applicable intellectual property laws.
These Terms do not grant you ownership of Flash's intellectual property.
13. Third-Party Services
Flash may integrate with third-party services, including payment, communications, authentication, analytics, and infrastructure providers.
Your use of those services may be subject to additional terms and privacy policies.
Flash is not responsible for third-party services outside of our reasonable control.
14. Disclaimers
The Services are provided on an "as is" and "as available" basis to the extent permitted by law.
Flash does not guarantee uninterrupted or error-free operation of the Services.
Flash does not provide medical advice and does not guarantee the quality, safety, outcome, or suitability of any tattoo service obtained through the platform.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Flash will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Services.
Flash is not responsible for acts, omissions, services, injuries, disputes, or other conduct of independent tattoo artists, studios, clients, or other users except to the extent liability cannot legally be excluded.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Flash and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses arising from your misuse of the Services, violation of these Terms, violation of applicable law, or infringement of another person's rights.
17. Suspension and Termination
We may suspend or terminate access to Flash if we reasonably believe you have violated these Terms, created risk for Flash or other users, engaged in fraudulent activity, or used the Services unlawfully.
You may stop using Flash at any time.
18. Changes to the Services or Terms
We may modify the Services and these Terms from time to time.
When we materially update these Terms, we will update the "Last Updated" date and provide additional notice where required by law.
19. Governing Law
These Terms are governed by applicable United States law and the laws of the state in which Flash is legally established, without regard to conflict-of-law principles, except where applicable law requires otherwise.
